Diminished Value in Georgia
Georgia: The Leading State for Diminished Value
Georgia is arguably the most favorable state in the nation for diminished value claimants. Following the landmark 2001 Georgia Supreme Court case State Farm Mut. Auto. Ins. Co. v. Mabry, Georgia became one of the only states to mandate that insurance companies must evaluate and pay diminished value on first-party claims (claims against your own insurance) as well as third-party claims. This means even if you were at fault, or if the at-fault driver is unknown, you may still be eligible to recover the lost market value of your vehicle.
The "17c Formula" Trap
Most insurers in Georgia use a simplified calculation known as the "17c Formula" to determine diminished value. This formula is notoriously biased toward the insurance company, typically capping payouts at 10% of the vehicle's value and applying aggressive deductions for mileage and damage severity. While the 17c formula was born out of the Mabry case, the Georgia Insurance Commissioner has explicitly stated that it is not the mandatory or only way to calculate value. Our certified appraisals are designed to challenge these 17c lowball offers by providing real-world market comparisons that reflect the actual loss in resale value.
4-Year Statute of Limitations
Under Georgia Code § 9-3-32, you have a generous four-year window from the date of the accident to file a property damage claim. This allows you to look back at past accidents, provided you haven't already signed a release. Because Georgia is an "at-fault" state with first-party recognition, every driver in Atlanta, Savannah, and beyond should investigate a DV claim after any significant collision.
